PROPOSED LOITERING AND CURFEW LAW

LOITERING:
- All property owned by the Town of Mina shall be closed between the hours of 10:00 p.m. and 6:00 a.m. No person or persons shall enter upon or remain in the property or any buildings or grounds thereof between the hours of 10:00 p.m. and 6:00 a.m. except pursuant to prior authorization of the Town Board or its delegate.
- Other property in the Town of Mina considered to be public in nature including such areas as the New York State Department of Environmental Conservation Fishing Access Area, the Findley Lake Volunteer Fire Department, the Marion LaBar Walford Memorial Water Wheel Overlook Building, the Findley Lake Watershed Foundation Gazebo, and the Tennis Courts, shall be closed between the hours of 10:00 p.m. and 6:00 a.m. No person or persons shall enter upon or remain in the property or any of those buildings or grounds thereof between the hours of 10:00 p.m. and 6:00 a.m. except pursuant to prior authorization of the governing body of that organization or its delegate.
- Violation of this section shall constitute the offense of disorderly conduct, as prescribed by the Penal Law of the State of New York as authorized by (Section xxxxxx, Town Law of the State of New York).
CURFEW:
- It shall be unlawful for any child or children under the age of sixteen (16) years to be loitering or to be in or upon any of the streets or sidewalks, alley or public places out-of-doors in the Town of Mina, New York, in the nighttime after the hour of 10:00 p.m. and before the hour of 6:00 a.m., unless accompanied by the parents or other adult guardian of such child or children, or unless such child or children shall bear a newly signed and dated statement from such parent or guardian, or other person having the legal care and custody of such child or children, that he or she or they are on an emergency errand.
- Any such child or children found after the time named in this ordinance upon said streets, sidewalks, alleys or public places in said town shall be warned by a town, county or state official therefore to go immediately to his, or their home or homes, and if after being so warned any such child or children shall be found loitering in or upon or being in or upon the streets, sidewalks, or alleys or any public place or places in said town out-of-doors, such child or children shall be taken by an official to his or their home or homes.
- Any parent, guardian or other person having the legal care and custody of such child or children permitting a violation of this resolution after having been warned in writing of the fact that such child or children has or have violated said resolution shall be guilty of a legal infraction, and may be fined upon conviction thereof for the first offense, the sum of twenty-five dollars ($25) and costs; and for the conviction of the second offense thereof, the sum of fifty dollars ($50) and costs; and for the conviction of any subsequent offense, the sum of one hundred dollars ($100) and costs; and it is further ordained that a violation of this ordinance shall constitute disorderly conduct and a person violating the same shall be a disorderly person.
